A fixed-term employment contract not to be concluded with an employee - Change to Code

June 17, Fineko/abc.az. The new draft law prepared by the Ministry of Labor & Social Protection on the amendments to the Labor Code proposes to improve Article 47 of the Code.

ABC.AZ reports that according to the Ministry, an employment contract must be concluded for an indefinite period, except for the cases established by Article 47 of the Code, in cases where, in accordance with current legislation, the work or services provided are permanent.

However, practice shows that in some cases conditions are created for abuse by employers.

As a result, there are facts of concluding fixed-term employment contracts with employees in cases where the work or services provided are known in advance and are of a permanent nature.

Therefore, the new bill provides for the elimination of circumstances that create conditions for early conclusion of an employment contract with an employee in cases where it was previously known that the work or services are permanent. To this end, amendments and additions will be made to the relevant articles of the Labor Code.
